Terms of Service

These Terms of Service ("Terms") are a legal agreement between you and Juniper House, LLC ("Bloom," "we," "us," or "our"), governing your use of the Bloom mobile application and related services (the "Service"). By creating an account or using Bloom, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use Bloom.

1. Who may use Bloom

You must be at least 18 years old and able to form a binding contract to use Bloom. By creating an account or using the Service, you represent and warrant that you are 18 or older. Bloom is intended for parents and prospective parents and is not directed to children. Bloom is currently offered in the United States only.

2. What Bloom is — and what it is not

Bloom is a personal journaling and family-companion app for the journey from before conception through early childhood. It helps you record memories, track your own journey, and reflect. Bloom is not a medical service — please read Section 3 carefully.

3. Not medical advice — important health disclaimer

Bloom does not provide medical advice, diagnosis, or treatment, and is not a substitute for professional medical care.

  • Bloom is not a medical device. It is not intended to diagnose, treat, cure, prevent, or monitor any disease or condition, and it is not a contraceptive, fertility-treatment, or family-planning tool.
  • All information Bloom provides — including cycle-related insights, body-signal observations, any notification that draws on your body signals, ovulation- or fertility-related information, weekly content, food and wellness guidance, due-date estimates, weight information, and milestone information — is for general informational and personal-reflection purposes only. It may be incomplete or inaccurate, may not apply to your situation, and must never be relied upon for medical decisions or for achieving or avoiding pregnancy.
  • Predictions and estimates are not guarantees. Cycle, fertility, due-date, and similar features are estimates and can be wrong.
  • Always consult a qualified healthcare professional about your health, pregnancy, fertility, or your child's health, and before acting on anything you see in Bloom.
  • In an emergency, call your local emergency number (911 in the U.S.) or seek immediate in-person care. Do not use Bloom for emergencies.

You acknowledge that you use any health-related information in Bloom at your own risk, and that Bloom and Juniper House, LLC are not responsible for decisions you make based on it.

4. Your account

You are responsible for keeping your account secure and for activity under it. Bloom uses Sign in with Apple for authentication. Notify us promptly at support@juniperhouse.io of any unauthorized use. You may delete your account at any time from within the app; deletion is described in the Privacy Policy.

7. Acceptable use

You agree not to use Bloom to: break the law; infringe others' rights; upload content you lack the rights to share; access others' accounts or data without authorization; interfere with, disrupt, or attack the Service or its infrastructure; or reverse-engineer, decompile, or disassemble the Service except to the extent that restriction is prohibited by applicable law.

8. Purchases — keepsake books and other paid items

Bloom offers physical keepsakes, such as the "Our Story" printed book, fulfilled through our print partner, Lulu.

9. Free service today; future paid features

Bloom is currently free, other than optional keepsake purchases. We reserve the right to introduce paid features or subscription tiers in the future and to change which features are free. If we do, we will describe the terms at that time, and any subscription will be governed by the applicable App Store terms. We will not begin charging you for a feature you are actively using without first giving you notice and the choice to decline.

10. Intellectual property

The Bloom app, its name, logo, design, illustrations, written content, and software are owned by Juniper House, LLC and protected by intellectual-property laws. We grant you a personal, non-transferable, non-exclusive, revocable license to use Bloom for personal, non-commercial purposes, subject to these Terms. You may not copy, modify, distribute, sell, or create derivative works from any part of the Service except as expressly permitted by these Terms or by applicable law.

11. Third-party services

Bloom relies on third-party services, including Apple (Sign in with Apple, Apple Health, app distribution), Supabase (hosting and data storage), Stripe (payments), and Lulu (print fulfillment). Your use of features that depend on those services may also be subject to their own terms and privacy policies. We are not responsible for third-party services we do not control.

12. Disclaimers

To the fullest extent permitted by law, Bloom is provided "as is" and "as available," without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, accurate, or secure, or that any estimate or insight it provides is correct. Some jurisdictions do not allow certain warranty disclaimers, so some of the above may not apply to you.

13. Limitation of liability

To the fullest extent permitted by law, Juniper House, LLC and its members, officers, and agents will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of data, profits, revenue, or goodwill, arising out of or relating to your use of (or inability to use) the Service, even if we have been advised of the possibility of such damages. To the fullest extent permitted by law, our total aggregate liability for any claim arising out of or relating to the Service will not exceed the greater of (a) the total amount you paid us in the twelve (12) months before the event giving rise to the claim, or (b) one hundred U.S. dollars (USD $100).

Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above may not apply to you.

14. Indemnification

To the fullest extent permitted by law, you agree to indemnify and hold harmless Juniper House, LLC and its members, officers, and agents from and against any claims, damages, losses, and reasonable expenses (including reasonable attorneys' fees) arising out of: your misuse of the Service; your violation of these Terms; your violation of any law; or your infringement of another person's rights, including in content you upload.

15. Termination

You may stop using Bloom and delete your account at any time from within the app. We may suspend or terminate your access if you materially violate these Terms, or as reasonably necessary to protect the Service, other users, or our rights. On account deletion, your data is handled as described in the Privacy Policy. Sections that by their nature should survive termination — including Sections 3, 6, 10, 12, 13, 14, and 16 — survive.

16. Governing law and dispute resolution

These Terms are governed by the laws of the State of South Dakota, without regard to conflict-of-laws rules.

a. Informal resolution first. Before starting a formal proceeding, you agree to contact us at support@juniperhouse.io and give us 30 days to resolve the issue informally. Many disputes can be resolved this way.

b. Binding arbitration. If we cannot resolve a dispute informally, you and Juniper House, LLC agree that any dispute, claim, or controversy arising out of or relating to these Terms or the Service will be resolved by binding individual arbitration, administered by a nationally recognized arbitration provider under its consumer arbitration rules, rather than in court. The Federal Arbitration Act governs the interpretation and enforcement of this section.

c. Class-action waiver. You and Juniper House, LLC agree that each may bring claims against the other only in an individual capacity, and not as a plaintiff or class member in any purported class, collective, consolidated, or representative proceeding. If this class-action waiver is found unenforceable as to a particular claim, that claim (and only that claim) shall proceed in court, and the rest of this Section 16 remains in effect.

d. Small-claims carve-out. Either party may bring an individual claim in small-claims court instead of arbitration, so long as the claim qualifies and remains in that court on an individual basis.

e. Your right to opt out. You may opt out of this arbitration agreement within 30 days of first accepting these Terms by emailing support@juniperhouse.io with your account email and a clear statement that you opt out of arbitration. If you opt out, disputes proceed in the courts identified below. Opting out of arbitration does not affect any other part of these Terms.

f. Court jurisdiction. For any dispute not subject to arbitration (including if the arbitration agreement is found unenforceable, or if you validly opt out), you and Juniper House, LLC consent to the exclusive jurisdiction and venue of the state and federal courts located in South Dakota.

17. Apple App Store terms

Because Bloom is distributed through the Apple App Store, the following apply, and to the extent they conflict with anything else in these Terms, they control with respect to your use of the App Store version of Bloom:

18. Changes to these Terms

We may update these Terms from time to time. For material changes, we will provide notice in the app and update the "Last updated" date. Your continued use after the effective date of the updated Terms means you accept them. If you do not agree to a change, you may stop using Bloom and delete your account.
